19 THE BUILDING SURVEYORS ACT, 2018 AN ACT of Parliament to provide for the registration and licencing of building surveyors, to regulate their practice and for connected purposes ENACTED by the Parliament of Kenya, as follows- PART I - PRELIMINARY This Act may be cited as the Building Surveyors Short title.

Act, 2018.

(1) In this Act, unless the context otherwise Interpretation.

"Cabinet Secretary" means the Cabinet Scrtary for the time being responsible for matters reIatingto lwusing; "chairperson" means the chairperson of the &ard appointed under section 5, "facilities management" means the integration of multi-disciplinary activities within the built envgonment and the management of the Impact of the activities upon people and the workplace;.

"practicing building surveyor" means a person who is registered and licensed under this Act and is carrying out the work of a building surveyor; 404 No.

(1) There is hereby established a Board to be the Board.

(2) The Board shall be a body corporate with perpetual succession and a common seal and shall, in its corporate name, be capable of- suing and being sued; taking, purchasing or otherwise acquiring, holding, charging and disposing of movable or immovable property; borrowing money; entering into contracts; and doing or performing all such other things or acts as may legally be done or performed by a body corporate for the proper discharge of its functions under this Act.

(2) Without prejudice to the generality of sub-section (1), the Board shall- promote the practice of building surveying that complies, with universally accepted norms and values; prescribe the minimum requirements and consider and approve the qualifications of persons wishing to be registered as building surveyors under this Act; maintain a register of all persons or firms registered under this Act; review and designate categories within the building surveying profession under which a person or firm may be registered; 405 2018 Building Surveyors No.

19 issue registration certificates and annual practicing license certificates to persons and firms qualified under this Act; levy such fees as it may determine for registration and grant of the annual practicing license including, other fees that the Board may consider necessary for the furtherance of its objectives; regulate the activities and conduct of registered persons and firms; establish and maintain a professional code of conduct for persons and firms registered to practice under this Act; establish, approve and accredit continuing professional educational programs for building surveyors; prescribe and conduct examinations for purposes of registration under this Act in collaboration with approved institutions; produce and disseminate material information in connection with the works and activities of the Board; (1) publish and circulate any material in connection with the building surveying profession and related matters; (m)promote awareness and educate the public on the professional duties and responsibilities of a building surveyor; publish annually in the Kenya Gazette a list of persons and firms practicing building surveying in Kenya; determine the fees to be charged by building surveyors and firms for professional services rendered from time to time; hear and determine such disputes relating to the professional conduct of building surveyors; and undertake any other activity that may be necessary for the fulfillment of any of its functions under this Act.

a chairperson, who shall be in private practice and a member of the Institution of Surveyors of Kenya (Building Surveyors Chapter); lour persons who shall be public officers and merbers of the Institution of Surveyors of Kenya (Building Surveyors Chapter); (C) three persons who are full members of the Institution of Surveyors of Kenya (Building Surveyors Chapter) appointed from persons nominated by the Institution of Surveyors of Kenya; one person who is a member of the Institution of Surveyors of Kenya (Building Surveyors Chapter) and who is a member of a recognized University; and the Registrar.

The Board may where it considers it appropriate, co-opt any person from outside the BOard with knowledge and expertise in specific areas to attend the deliberations of any of its committees.

All decisions by the committees established under subsection (1) shall be ratified by the Board.


Tenure of office.

(I) The chairperson or member of the Board, except an e.vo/ticw member, shall hold office for a term of 407 2018 Building Surveyors No.

19 three years on such terms and conditions as may be specified in the instrument of appointment but shall be eligible for re-appointment for one further term.

(2) A member, other than an ex officio member may - at any time resign from office by notice, in writing, to the Cabinet Secretary; be removed from office by the Cabinet Secretary on recommendation of the Board if the member- has been absent from three consecutive meetings of the Board without the permission of the Board; is convicted of a criminal offence and sentenced to imprisonment for a.

term of not less than six months; is incapacitated by prolonged physical or mental illness for a period exceeding six months; ceases to be a registered person under this Act; is otherwise unable or unfit to discharge functions of the office;.

is deceased; has been declared bankrupt; or where a member appointed by virtue of being a public officer, ceases to be one.

(3) Where a vacancy occurs in the membership of the Board under subsection (2), the Cabinet Secretary shall appoint a new member in accordance with the provision of this Act.

19 Building Surveyors 2018 Any document purporting to be under the seal of the Board or issued on behalf of the Board shall be received in evidence and shall be deemed to be so executed or issued, as the case may be, without further, proof, unless the contrary is proved.

Notwithstanding subsection (2), the Board shall, in the absence of the chairperson or the Registrar, nominate one member of the Board to authenticate the seal on behalf of either the chairperson or the Registrar.

A deed, instrument, contract or other document executed in accordance with subsection (2) shall bind the Board.


(1) No matter or thing done by a member of the Prottion from Board or any officer, employee or agent of the Board shall, prsonaI IIflblIity, if the matter or thing is done in good faith for executing the functions, powers or duties of the .Board, render the member, officer, employee or agent or any person acting under the directions personally liable to any action, claim or demands whatsoever, (2) The provisions of subsection (1) shall not relieve the Board of the liability to pay lawful compensation or damages to any person for injury to the person or property.

The Registrar shall serve on 'such terms and conditions as'the Board may determine.

The Registrar shall be the chief executive officer of the Board and the secretary to the Board.

The Registrar shall be an ex officio member of the Board but shall have no right to vote at any meeting of the Board.

Where the name of a person has been entered in the register, the Board shall issue that person with a certificate of registration, in the prescribed form, upon payment of the prescribed fee and the certificate shall remain the property of the Board.

Where the name of a person has been removed from the register, the Board shall give notice to that person, requiring the person to surrender the certificate of registration to the Board.

A person who fails to comply with the requirements of a notice given under subsection (3) within twenty-one days after the receipt of that notice commits an offence and is 410 No.

19 Building Surveyors 2018 liable on conviction, to a fine not exceeding five hundred thousand shillings, or to imprisonment for a term not exceeding six months or to both.

(5) In the event of the certificate of registration being lost or destroyed and the loss of destruction being proved to the satisfaction of the Board, the Board shall issue a duplicate registration certificate to the building surveyor on payment of the, prescribed fee.


(1) Every person who has been registered under this Annual pt1cticu1g Act shall, if he or she intends to practice in his or her licence, professional capacity, require, in addition to such registration, an annual licence in the prescribed form on payment to the Board of the prescribed fee.

(2) Every annual licence shall bear the license number and the date on which it is issued, shall be effective from that date and shall expire at the end of the licence year in which it is issued.

(3) The licence year shall be from the first January to the thirty first December in each year.

(4) The Registrar shall enter in the register, a notice of the date of issue of every licence issued under this Act.

(5) For the purposes of this Act, a person shall be deemed to practice in his professional capacity if he engages exclusively in his profession- on his own account and is entitled to receive the entire amount of all fees or charges earned for his own financial benefit; or in partnership with others and is entitled to receive a share of the profit earned by such partnership for his own financial benefit and is liable to bear a share of any losses incurred by such partnership.

(6) No person shall be deemed to be practicing in his or her personal professional capacity where the person is employed by- the Government or any other public body; any state corporation as defined by the State Corporations Act; or Cap.446 any person or partnership engaged in his or her profession where all fees earned accrue to the 411 2018 No.

(1) The Board shall cause to be published in the Publication of Gazette, as soon as may be practicable after entry in the register.

(1) In any legal proceedings, a document purporting Proofof CL to be a copy of, or an extract from the register, shall be admissible as prima facie evidence of the contents of the register or document provided that it is certified by the Registrar.

(2) The Registrar shall not, in any legal proceedings to which the Registrar is not a party, be compelled to- produce the register or any document if its contents can be proved under subsection (1); or appear as a witness to prove an entry in the register or the matters recorded in the register or any document unless the court, for special cause ,so orders.


A person may apply to the Board in the prescribed Conditions and form to be registered under this Act and to have his or her qualifications for name entered in the register if the person is- registration.

19 Building Surveyors 2018 a member of the Institution of Surveyors of Kenya (Building Surveyors Chapter) or a corporate member of the Royal Institution of Chartered Surveyors and he or she is qualified to be or is a full member of the Institution of Surveyors of Kenya (Building Surveyors Chapter).

(2) An application for registration under this section shall be in the prescribed form and be accompanied by the prescribed fee () The Board shall reu!re a person registered under this section to produce documentary evidence of his or her education, work or employment immediately prior to coming to Kenya and may require that person to appear before it for the purpose of considering his or her application.

(2) Except in the circumstances specified in subsection (1) (a), the removal of a person's name from the register shall be notified by the Board to the registered person by registered post to the last known address of the building surveyor.

(3) The Board shall cause to be published in the Gazette, as soon as practicable, the name, address and qualifications of a person whose name is removed from the register under this section.

(2) A direction given by the Board under subsection (1) may include- the date upon which restoration in the register or the termination of a suspension of registration shall take effect; and the payment by the person concerned of such fee, not exceeding the fee payable on an application for registration, as the Board may prescribe.

(3) Any summons or order issued under the hand of the chairperson or the vice-chairperson shall be deemed to have been issued by the Board.

(4) The chairperson, or in his absence the vice- chairperson of the Board shall cause to be recorded a summary of any oral evidence at an inquiry held by the Board.

(5) Subject to this section and to any regulations made under section 39, the Board shall have power to regulate its own procedure.

19 2018 Building Surveyors For the purposes of an inquiry held under this Act, the Board shall, not less than twenty-one days prior to the date of inquiry, notify by registered post, all the persons concerned.

Any person upon whom summons or an order is served under this section by the chairperson or vice- chairperson of the Board who- refuses or neglects without sufficient cause to attnd at the inquiry; refuses without sufficient cause to answer fully and satisfactorily to the best of his knowledge and belief all questions put to him or her by or with the concurrence of the Board; or (b) refuses or omits without sufficient cause to produce any document in his possession or under his or her control which is specified in the summons or order, commits an offence and is liable, on conviction to a fine not exceeding four.

(3) The annual estimates shall be approved by the Board before the commencement of the financial year to which they relate and once approved, the sum provided in the estimates shall be submitted to the Cabinet Secretary for approval.

(4) No expenditure shall be incurred for the purposes of the Board except in accordance with the annual estimates approved under subsection (3), or in pursuance.

(1) The Board shall cause to be kept all proper Accounts and books and records or accounts relating to the income, au expenditure, assets and liabilities of the Board.

(2) Within a period of three months after the end of a financial year, the Board shall submit to the Auditor-General the accounts of the Board for that year together with - a statement of income and expenditure during the year; and a statement of the assets and liabilities of the Board as on the last day of that year.

(3) The accounts of the Board shall be audited by the No.34 of 2015.

(2) For the purpose of subsection (I), the minimum guarantee bond or policy of insurance entered into or issued by in insurance company, shall be in the case of business carried on by an individual building surveyor, a sum of two hundred thousand shillings; in the ease of a business carded on by two or more individuals, the sum of two hundred thousand shilflrigs multiplkd by the number of buildhig surveyors; and (e) in the ease of business carried on by a body corporate, the sum of two hundred thousand shillings multiplied by the number of directors whose acts include the doing of acts or practice as building surveyors.

(3) Any person who contravenes sub-section (1) commits an offence and is liable on conviction to a fine not exceeding twenty thousand shillings or to imprisonment for a term not exceeding two years or to both.

Any person who- Dishonest practices.

fraudulently makes, causes or permits to be made, any false or incorrect entry in the register or any copy thereof; or fraudulently procures or attempts to procure the entry in the register of any name or other particulars whether on his own behalf or on the behalf of any other person; or knowingly and willfully makes any statement, oral or written, which is false in a material particular or which is misleading with a view to gaining any advantage to privilege under this Act whether for himself or for.any other person, commits an offense and is liable, on conviction, to a fine not exceeding fifty thousand' shillings or to imprisonment for a term of three years or to both.


(1) The Cabinet Secretary may, in consultation with Regulations.

the Board, make regulations generally for the better carrying out of the purposes of this Act.

(2) Without prejudice to the generality of subsection (1), Regulations made under this section may prescribe- the form and method of keeping records under this Act; the procedure for applications for registration under this Act; the fees to be charged under this Act; the forms to be used for the purposes of this Act; the remuneration of building surveyors in respect of services rendered; and (1) any other thing required to be prescribed.

(1) The Board shall meet not less than four times in Meetings.

Notwithstanding the provisions of subparagraph (1), the chairperson may, and upon requisition in writing by at least five members shall, convene a special meeting of the Board at any time for the, transaction of the business of the Board Unless three quarters of the total members of the Board otherwise agree, at least fourteen days' written notice of every meeting of the Board shall be given to every member of the Board.

The quorum for the conduct of the business, of the Board shall be seven and no meeting shall be held or continued, notwithstanding that there is a quorum, unless the Registrar or a person deputed by him is present.

The chairperson shall preside at every meeting of the Board at which he is present but, in the absence of the chairperson, the members present shall elect one of their numbers to preside, who shall, with respect to that meeting and the business transacted, have all the powers of the chairperson.
